Your lordship, Dña. María de los Angles Antón Padilla, declared the contract signed between my client and Silverpoint null and void because there were no reference to its termination date and the object had not been described as article 9.1.3 of Law 42/98 requires. The judgment, although having considered the existence of advanced payments decides not to grant it because as the contract is null and void which means, under the Spanish legal system, as if it has never existed, neither then any anticipated monies. Consequently the claim now is on appeal because we are clearly against this legal conclusion.
