This is an old judgement that I did not post at the time. On this occasion, the Court of First Instance No. 3 of San Bartolomé de Tirajana ordered Anfi to pay my clients the lump sum of 35,552 euros, declaring the contract void and acknowledging the payment of unduly anticipated amounts. It also orders the payment of expenses and legal interests.
Anfi appealed this decision at the time and is now in the appeal phase, in the 3rd Chamber of the Provincial Court of Las Palmas, appeal number 1064/2019. I hope we can have a verdict confirming the current one before the summer of next year. As you can see, the sentence that I now publish is dated September 23, 2019, so the appeal phase is currently taking around two years if there are no problems or delays.
Notwithstanding what has been said, and to avoid these delays, what I am doing for my clients is to initiate what is known as "provisional execution". This is a power that the law grants to those who have already obtained a judgment that contains a condemn to pay an amount of money. In this way, we don't have to wait for the end of all resources (Anfi could even consider raising this matter to the Supreme Court with the delay that this would entail) and can start to "seek" the return of the monies that have been granted to my clients.
